Decree No. 77/1965 Coll. on training, competence and registration operation of construction machines (the “Decree no. 77/1965 Coll.”) was released as an implementing regulation to the Act No. 65 / 1961 Coll. on Occupational Safety and Health at Work ( “OSH”). Because, the Act No. 65/1961 Coll. on OSH was cancelled on 01st January 1966 by the Act No. 65/1965 Coll., that day also become ineffective Decree No. 77/1965 Coll.
Ústav vzdelávania a služieb was established by decision of the Ministry of Construction and Technology to day 16th March 1970 (the “IES”).
Trust deed No. 341/M-1999 issued by the Minister of Construction and Regional Development SR on 25th February 1999 was set up state-subsidized organization Ústav vzdelávania a služieb Bratislava, Tax ID No.: 214900 (hereinafter also “IES SPO”).
           Ústavom vzdelávania a služieb was included in the privatization within the meaning of Government No. 851 on 25th October in 2000 and 2002 and there was its privatization direct selling to the company Ústav vzdelávania a služieb, s. r. o., Address: Bárdošová 33, Tax ID No.: 35 810 700, Registered in the Business Register on 25th April 2001 (hereinafter also „UVS s. r. o.”). Trust deed lost by selling its foundation in analogy with the privatization Ústav vzdelávania a služieb No. 341/M-1999 on 25th February 1999.
           At the time of validity of the Decree No. 77/1965 Coll., i. e. to 01st January 1966 grant authorization for the service of construction machine and issue the license was under the responsibility of the Ministry of Construction or its delegated authority.
           Ústav vzdelávania a služieb was established on 16th March 1970, Ústav vzdelávania a služieb established on 25th February 1999 and neither ÚVS s. r. o. Registered in the Business Register on 25th April 2001 they should not be authorized as authorities of the Ministry of Construction to issue licenses in accordance with § 9 paragraph 1 Decree No. 77/1965 Coll., because it was already invalid.
           Issuing of written documents of completion of education and training for service of selected construction machinery and equipment with a focus on health and safety at work by authorized person for education and training for service of construction machinery and equipment, within the meaning of the applicable provisions of Act No. 124/2006 Coll. on safety and health at work and  amending and supplementing certain acts as amended (hereinafter also „Act No. 124/2006 Coll.“) and Decree No. 356/2007 Coll. laying down details of the requirements and range of educational activities, on project of education and training, management of prescribed documentation and verification of knowledge of participants of educational activity (hereinafter also j „Decree No. 356/2007 Coll.“), therefore licenses of operators of construction machinery issued under Decree No.77/1965 Coll. Ústav vzdelávania a služieb s. r. o. was considered as invalid. There is not possible to update training every five years when license is invalid according to § 16 paragraph 8 of Act No. 124/2006 Coll.  
         We point out, if the engineer shows his or her card issued by Decree No. 77/1965 Coll. during Labour inspection or when investigating an accident at work, following the above, submitted card does not fulfil the requirements of § 16 paragraph 1 point b) of the Act No. 124/2006 Coll.
