By Resolution of the Government of the Slovak Republic no. 446 of September 13, 2023, the emergency situation in connection with the threat to public health is invoked II. degree due to the disease COVID-19 caused by the SARS-CoV-2 corona virus on the territory of the Slovak Republic, which was declared on March 12, 2020. The revocation of the emergency situation takes effect on September 15, 2023 at 6:00 a.m.
Revocation of the emergency situation will affect the rights and obligations of the employee and the employer resulting from labor relations, which were changed by temporary legal regulation in connection with the emergency situation.
These are mainly the following changes:
- upon the expiry of two months after the lifting of the emergency situation, the effect of the transitional provision § 252o of Act no. 311/2001 Coll. Labor Code,
- upon the expiry of one month after the lifting of the emergency situation, the effect of the transitional provisions of § 39i of Act no. 124/2006 Coll. on safety and health protection at work, which regulate some deadlines in relation to obligations in the field of safety and health protection at work,
- by the end of the emergency situation, or upon the expiration of one month after its revocation, the effect of the transitional provisions of § 131i of Act no. 404/2011 Coll. on the residence of foreigners, which regulate certain deadlines in relation to the residence of a national of a third country on the territory of the Slovak Republic.
The National Labor Inspectorate points out that the emergency situation in connection with the mass influx of foreigners to the territory of the Slovak Republic caused by the armed conflict on the territory of Ukraine, which was declared by the government of the Slovak Republic as of February 26, 2022, currently continues.
